Medicaid Fraud Control Unit (MFCU)
The Medicaid Fraud Control Unit (MFCU) is part of the Attorney General’s Office. MFCU is a law enforcement agency charged with investigating and prosecuting Medicaid fraud amongst New York providers.
MFCU has several regional offices and their NYC office is located at 120 Broadway in Manhattan (right across the street from us).
When you deal with MFCU, you need to be aware of a few things.
First, this is a law enforcement agency and you are a target of a criminal investigation. MFCU is extremely aggressive and they are willing to file criminal charges even in grey area cases where it’s not clear that they would actually accomplish their goals.
The way MFCU operates is similar to federal criminal investigations. Agents may show up at your office and ask you questions. Or they will speak with your patients or staff. They may ask you to provide documentation, etc.
Whatever the case may be, be assured that speaking with the agents will make your prosecution and conviction much more likely. I’m not saying it’s always bad to speak with investigators, but speaking with them before speaking with a lawyer is always a bad idea, trust me.
Just like in all criminal investigations, the agents don’t really decide anything. Their job is to get the evidence. What to do with the evidence is up to the prosecutor, in this case an Assistant Attorney General.
Not all MFCU cases are criminal, though. They also have a Civil Enforcement Division. Your case may not be prosecuted in criminal court but the government will file a civil law suit against you. Your Medicaid payments can also be withheld until your case is resolved.
